Welcome to El Maksoura! The terms "we", "us" and "our" refer to El Maksoura. We operate this store and website, including all related information, content, features, tools, products and services, to provide you, the customer, with a curated shopping experience (the "Services"). El Maksoura is powered by Shopify, which enables us to provide the Services to you.

These terms and conditions, together with any policies referenced herein (these "Terms of Service" or "Terms"), describe your rights and responsibilities when you use the Services. Please read them carefully, as they include important information about your legal rights, including warranty disclaimers and limitations of liability.

By visiting, interacting with, or using our Services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, you should not use or access our Services.

SECTION 1 – ACCESS AND ACCOUNT

By agreeing to these Terms, you represent that you are at least 18 years of age, or the age of majority in Tunisia, and that you consent to allow any minor dependents to use the Services on devices you own or manage.

To use the Services — including browsing our store or purchasing products — you may be asked to provide certain information such as your name, phone number, email address, and delivery address. You represent that all information you provide is correct, current, and complete.

You are solely responsible for maintaining the security of your account credentials and for all activity under your account. You may not transfer, sell, or assign your account to anyone else.

SECTION 2 – OUR PRODUCTS

We have made every effort to represent our products accurately. However, colors and appearance may differ from how they appear on your screen depending on your device.

Our products are natural food items (honey, honeycomb, and olive oil). Natural variations in color, texture, and crystallization may occur between batches and are normal — they are not defects. Honey may crystallize over time; this is a natural property of pure honey and does not affect quality.

All product descriptions are subject to change at any time at our discretion. We reserve the right to discontinue any product and to limit the quantities we offer to any person or region.

SECTION 3 – ORDERS

When you place an order, you are making an offer to purchase. El Maksoura reserves the right to accept or decline any order at its discretion. Your order is not accepted until we confirm it — typically by a confirmation phone call before dispatch.

Please review your order carefully before submitting. You may cancel within 24 hours of placing your order, as described in our Return and Cancellation Policy. After an order has been dispatched, we may be unable to accommodate cancellation requests.

Your purchases are subject to return or exchange solely in accordance with our Return and Cancellation Policy.

SECTION 4 – PRICES AND PAYMENT

All prices are listed in Tunisian Dinars (TND). Prices, discounts, and promotions are subject to change without notice. The price charged will be the price in effect at the time the order is placed.

We currently accept Cash on Delivery (COD) — you pay in cash when your order is delivered. Additional payment methods may be added in the future. Unless otherwise stated, posted prices do not include delivery charges, which will be shown before you confirm your order.

You agree to provide accurate purchase and contact information so we can process and deliver your order and contact you as needed. You agree to pay the full amount due, including any delivery charges, upon receipt of your order.

SECTION 5 – SHIPPING AND DELIVERY

We deliver within Tunisia. All delivery times are estimates only and are not guaranteed. We are not liable for delays caused by delivery carriers or events outside our control. We will contact you to confirm your order and arrange delivery.

Because our products are food items, we ask that you inspect your order at the time of delivery and raise any issue with the damaged or incorrect item immediately (see our Return and Cancellation Policy).

SECTION 6 – INTELLECTUAL PROPERTY

Our Services — including all trademarks, brand names, text, images, graphics, video, and audio, and the design and arrangement thereof — are owned by El Maksoura or its licensors and are protected by applicable intellectual property laws.

These Terms permit you to use the Services for your personal, non-commercial use only. You may not reproduce, distribute, modify, republish, or transmit any material from the Services without our prior written consent. El Maksoura's names, logos, and designs are our trademarks and may not be used without our written permission. Shopify's name and logo are trademarks of Shopify.

The Services may provide access to third-party tools and links to third-party websites that we do not control or monitor. These are provided "as is" without warranties, and we are not liable for your use of them. SECTION 8 – RELATIONSHIP WITH SHOPIFY

El Maksoura is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our store are made directly with El Maksoura. You acknowledge that Shopify is not responsible for any aspect of sales between you and El Maksoura, including any injury, damage, or loss resulting from purchased products. You release Shopify and its affiliates from all claims arising from your purchases with El Maksoura.

SECTION 9 – PRIVACY POLICY

All personal information we collect is subject to our Privacy Policy. Because the Services are hosted by Shopify, Shopify also collects and processes information about your use of the Services to provide them. By using the Services, you acknowledge that you have read our Privacy Policy.

If you submit any ideas, suggestions, reviews, or other content ("Feedback"), you grant us a perpetual, worldwide, royalty-free license to use, reproduce, modify, publish, and display that Feedback for any purpose, including commercial use. If any provision of these Terms is found to be unlawful or unenforceable, that provision shall be enforced to the fullest extent permitted, and the remaining provisions shall remain in full force and effect.

These Terms are governed by and construed in accordance with the laws of the Republic of Tunisia. Any disputes shall be subject to the jurisdiction of the competent courts of Tunisia.
